Joshua Rosa (X) youth minister, now convicted murderer.

Joshua Rosa, the (X) youth minister, was convicted today of first degree murder.

Jurors found Joshua Rosa, 22, guilty of first-degree murder as charged "and the killing was committed during the commission of or in the attempt to commit aggravated child abuse."

The judge sentenced him to life in prison without the possibility of parole.
Tomlinson's father said Rosa destroyed his life.

"Your honor, I'm so glad this is over," said Ron Tomlinson. "I can move on. I want him to know he took something from me I'll never get back again. My grandkids, I'll never see my grandkids. I'll never see my son drive a car. I'll never see my son's wife. None of that. My life is destroyed. I want him to know that's what he did to me."

Mr. Tomlinson had a brilliant thought and told Rosa that there should be a picture of his dead son in his cell so everyday he was reminded of what he had done and what he had taken away from his family.

The press asked Mr. Tomlinson after the trial if he could say anything else to Rosa what would it be?

Tomlinson simply stated “burn in hell”

Jurors delivered the verdict to the court this morning.

Here is a run down of the events that happened in this case.

December 8, 2005.
The body of 13-year-old Stephen Tomlinson was found in Logan Gate Park.

The police then reported that a group of teenage boys discovered the body in the woods behind the park. The boy was partially clothed and lying next to his bicycle.

Apparently Joshua Rosa was there and went out of the woods to report a dead body and later he tried to run and was held there by Tomlinson’s uncle until police arrived.
The police questioned Joshua Rosa that night and did not arrest him at that time.

Investigators said Tomlinson suffered trauma to the upper body.

December 12, 2005

Hillsborough County Sheriff David Gee said he is confident his investigators will solve the case. The medical examiner has ruled the cause of death was manual strangulation.

Gee then said investigators are still waiting on forensics test results and tips from the public before making an arrest.

Stephen's father, Ron Tomlinson, also encouraged anyone with information to come forward.

"Anybody that's got any information, I beg you, please come forward so we can get this thing over with and done, so I can get some closure and put it behind me, and my family," said Tomlinson.

January 7, 2006

A suspect has been arrested in the murder of 13-year-old Stephen Tomlinson in December.

Hillsborough County Sheriff David Gee said Joshua Rosa, 19, has been charged with Tomlinson's murder

Gee said that late Friday afternoon the sheriff's office received a report from the Florida Department of Law Enforcement indicating that Tomlinson's DNA was found on nail clippers belonging to Rosa and blood on gloves belonging to Rosa was Tomlinson's blood.

Gee also said that Rosa's statements to detectives were inconsistent.

"The only consistent thing about his statements was their inconsistency," Gee said.

Gee said the sheriff's office does not have a motive for the murder, but Tomlinson's clothing was in disarray when he was found.

The sheriff has kept Rosa under surveillance since the murder. He is being held without bond.

February 6, 2006

Joshua Rosa, accused of killing 13-year-old Stephen Tomlinson entered a not-guilty plea Monday in Hillsborough County court.

Rosa told police he lost the keys while jogging, but later told police he found Tomlinson's body and tried to revive him.

July 14, 2008

The trial of a former youth minister accused of the murder of teenage boy begins today in Hillsborough County.
Rosa, a 19-year-old youth minister who worked at the nearby Zion Pentecostal Church at the time of the murder, became a prime suspect once police began questioning witnesses.
They told investigators they saw Rosa, at the park about the time of Tomlinson's death.
Tomlinson's body was found December 8, 2005 in the woods behind the park. His partially clothed body was lying next to his bicycle. He was 13.
Jury selection began today.

Tuesday, July 15, 2008

Opening statements began Tuesday in the Stephen Tomlinson murder case.
Jurors will have to decide whether 22-year-old Joshua Rosa is guilty of killing Tomlinson, who was 13-years-old when he was found strangled to death.
Rosa's attorney said the wrong person is on trial.
Prosecutors say DNA on Tomlinson matched Rosa's DNA. Rosa's attorney says he was just trying to help the victim at the crime scene.

Monday, July 21, 2008

A man accused of killing 13-year-old Stephen Tomlinson has been found guilty. Joshua Rosa was convicted of first degree murder.
The prosecution did not pursue the death penalty in this case and the reasons they did not are unclear.

The Sheriff made this statement, some time ago, that they had no motive for this murder, but told the community to draw their own conclusions since Tomlinson clothing was in disarray.

The media interviewed Tomlinson’s brother. He said he knew the defendant and had played video games with him before and thought he was a good guy since he was the youth minister at the church his brother attended. He went on to say that there was an overwhelming amount of evidence against Rosa and he believes the motive for this case was Rosa attempted to rape his brother and his brother fought back.

A lot of the evidence was never heard in court. The recordings of statements and all of the inconsistent statements Rosa made was never heard in court. One reporter said the first time the jury heard Rosa’s voice was after the conviction and Rosa was allowed to make a statement.

Rosa did say in his statement that he knew things looked suspicious against him but he was not the perpetrator in this case.

Rosa went on to say he only hopes the person or people responsible for this death are caught.

I know this is a touchy subject and the majority of time defendants never take the stand in their own defense, but I think if I was facing life in prison without parole and was honestly innocent, I would be on the stand fighting for my innocence. Rosa only elected to make a statement post conviction to proclaim his is innocent in the murder of Stephen Tomlinson.

This Boy is 19-years old. I do not think that he committed this crime. There is no way this guy killed this 13-year old boy. Records show several registered sex criminals that live right next to that park. Witnesses only saw someone walking away. DNA evidence showed Joshua Rosa had contact with the boy. That does not mean he killed him. Even though the cops said his statements were inconsistant, so what, he is 19-years old-thats crap. Did the cops interview any of the registered sex offenders that live right next to the park?
Another mistake by the Failed Criminal Justice system.

You Steve must be as crazy as this punk child killer to think a 19 year old can not kill. What are you thinking?12 years old kill so why not 19?This guy not kid was running from the scene with blood all over him his keys where found under the dead boy, wittness who know this punk/Rosa was running scared of the cops and told them to "put me somewhere".

To Steve's defense; most of you need to shut your mouths. I watched the trial myself, and knew Josh Rosa from school. Josh was wrongly convicted and everyone who's watched this trial knows it for fact. The fact that nobody hung the jury is an absolute calamity. Witnesses (Whitley) lied on the stand and contradicted themselves. Rosa never hid from the cops, he ran out of the park and was trying to get help. People were attacking him thinking he did it, so the cops had to bring him into a safe area.
Other witnesses also stated at the scene that they didn't think he did it either. LEARN YOUR FACTS BEFORE YOU ACCUSE! That is exactly what this case is all about... wrong accusations. Josh was trying to save this boy who was a member of his youth group at church. I hope he appeals this case with a great attorney because Josh did not get the justice he deserved and there's still a killer out there...

Also I'd like to show off another article.. http://www.myfoxtampabay.com/myfox/pages/News/Detail?contentId=6940601&version=2&locale=EN-US&layoutCode=TSTY&pageId=3.2.1

Ron Tomlinson sues the church? Oh because money heals all problems right? You people are clowns... I bet you voted for Bush too right?

Steve,

Sorry to hear that you think our criminal justice system failed in this case.

We will have very different opinions on this topic.

After reading all the evidence and hearing the statements of the crime that was never admitted into evidence at trial, I must say I think the system worked just fine in this case.

I could have had a little more belief in Rosa if his keys were not found under the body.
And then he lied about how they got there, or maybe not lied but gave several inconsistent statements.

Also with the detailed description of how the blood ended up on his gloves was pretty damning. Forensic evidence is hard to disregard.

Jesse,

Joshua Rosa has been convicted.

There are no accusations being made at this point.

The jury found him to be guilty beyond any reasonable doubt.

Thanks for the link to the other story, I read that this morning.

This is for R Keegan, F You. Do you believe everything the cops say? Do you think everything on TV is accurate and correct? You are a fool and a stupid idiot. You must of voted for Bush, you fool. There are hundreds of thousands of people accused every year for crimes they did not commit. I want the real killer to be behind bars, not an innocent kid (joshua rosa). Wake the F up you idiot!!!

Maybe I'm naive, but I have a hard time believing that this kid with no record and no history of violence whatsoever could beat this child to death with his own hands. It doesn't make sense, not that any murder does really. I just don't buy it. I watched the trial, and I think this kid didn't help himself any. He may be guilty of stupidity, but murder? I don't see it.

I watch this trial beginning to end. I read many newspaper articles that had stories: the keys under the body... etc. However, in TRIAL, these things were never proven, sometimes never even brought up by the prosec.
Another thing I noticed, the papers had sooo many incorrect facts, facts that were dispoved in trial, from Rosa's arrest date, to how many witnesses... yet they were irresponsibly printed! That angers me because press sways public opinion. As a jury member, I would be hard pressed to convict, for no other reason than this: no eveidence proved reasonable doubt.
BUUUUT!!!! I sat in front of my TV one day and watched testimony that a drop of the victim's blood was found INSIDE the pants AT THE KNEE of J Rosa. WHY ISN'T ANYONE TALKING ABOUT THAT????
Still, I would not have been able to say guilty beyond a reasonable doubt as a jurror. I feel for the fam of Stephen, I am a Mom. But we have to be Oh SO CAreFul with our justice system as democracy keeps us free.
I really hope Rosa WAS guilty because that boy is in for hell if he isn't.
And, I voted for Bush.

Kp, I’m not here to try to change your mind about the verdict of the case. The jury has spoken.

But when you look at all the comments about Rosa, most of which praise him, but reading over some responses made by his very own friends, they said he had changed once he started boxing.

His attitude changed and he even went out of his way to cause conflict with some people.

His criminal record (or lack of one) does not and did not bear a lot of weight with the jury and nor should it.

Look at all the serial killers that had a clean record.

april

Thanks for your comments as well.

If you did watch the entire trial then you would know a lot of issues were never brought up in court.

Like one reporter said, the jury never heard Rosa’s voice until after he was convicted.

What happened to all the interviews with police?
Why was those recordings never introduced into evidence?

How his brother thinks Rosa had the intent of rapping his brother and his brother fought back.

And the blood inside his pants, did Rosa have his pants down when this happened? Is that what you are trying to say with your comment?

Seems everyone has eliminated the homosexual aspect of this case and just focused on Joshua is a nice guy.

Sadly for you guys that support Rosa, he was at the scene, had the victims DNA on his gloves and nail clippers.

The jury spoke loud and clear and found him guilty beyond a reasonable doubt.

The Judge should have called it a deadlock jury. this kid did not do this sexual crime. he has no record of sexual crimes against anyone. He tried to help his friend and the stupid cops had to find someone to convict or they would look stupid and worthless(most of them are anyway). Everyone needs to wake the F up about our crazy criminal justice system. It is fail and needs to be completely revised. TOO many judges and politicians are corrupt and way over paid. Several Sex offenders are registered right next to that park. One of them is laughing right now because he is still out there rapping and killing kids while the innocent kid(Joshua Rosa) is in jail for the rest of his life. F all the judges, cops, and all you idiots who don't use common sense about this horrible outcome of this case. And the father of the victim is a money hungry asshole who would of convicted anyone just to get money. What an asshole father.

Bobby,

Thanks for your comment.

However, I must say I disagree with you on several topics. But to each their own…

I do want to say this, all these people claim Rosa is innocent and can only base it on the fact that a child molester lives in the area. Sadly that is the case for this entire portion of the state, look it up on line, they are everywhere.

Does not mean they are guilty of murder because they live in the area.

I would like to know if anyone has any actual evidence to support his innocence.

Other than he is a nice guy?

Overall I think we have an awesome criminal justice system, sure there are problems with the system but overall the system does its job pretty well.

Of course if people could learn simple basic concepts of right and wrong and do the right thing and tell the truth, we would have no use for the system. Not that we will ever see that happen so we have people that want to blame the system for everything wrong in the world.

By the way the same system you curse, would prosecute your laughing neighbor if you presented your case to the system and he was found to be in violation of law. That’s one thing about the system; it keeps the wheels of justice turning full speed ahead and it never stops for anyone.

By the way speaking of evidence

DNA – was other DNA evidence found? Rosa and Tomlinson had each others DNA on each other (not the child molester down the street)

Keys – Seems the keys found under the body belonged to Rosa (not the child molester)

Statements – Seems the only consistent thing about Rosa’s statements was the fact they were continuously inconsistent. (Not the child molester)

Maybe people need to realize he is actually guilty of this crime.

I have asked that everyone leave a response as to why they thought he was innocent and needless to say not one single supporter has left one single comment.

I missed the defense portion of the trial. So I don’t know anything about what the defense presented but apparently the statement that was in the paper that the wrong man was arrested did not seem to carry a lot of weight with the jury.

The jury seemed pretty quick and confident in the verdict they reached.

I don’t know Mr. Tomlinson, he said his plans in the law suite was to make the park a safer place and he has taken a lot of action upon himself to try to help ensure the safety of the other kids in the park.

By they way, he did not convict anyone, the jury convicted Rosa and that conviction had nothing to do with money for Mr. Tomlinson.

Climb down off your high horse for a minute and realize this man lost his son and you want to curse his name, you need to find some other blog to do that sir.

Last but not least there was no reason to call it a deadlock jury, seems when they were polled they all voted guilty. No deadlock there.

Hi i just what to bring up a few things.

1. Do anyone know why really the jury convicted Joshua?

2. Do anyone know how the press work in mind of everyone?

3. Do anyone how think Joshua is guilty knows him?

4. Do Joshua was guilty beyond any reasonable doubt?

5. Do the system really works?

Well i know Joshua and im not goin to say he is a nice guy because i know he is! I don't think he do it not because he was in the church or something like that is just because of the facts. We, the jury and the system can't prove that he kill that boy! We were not there we ONLY have a few evidence that tells us he was there but didn't tells us that he kill. I can understand that his statements were inconsistant because if you saw someone that you know being death you would losse your mind. I know how that feel i find someone that i love in that circustance! The system fail is not prefect like us we have people in the jail for years and then for some reason they find out they are innocent. The press sometime works in favor of someone but not in purpose. I know the system and i know the press very well and i know that sometimes things mess up! I'm soo sorry for the Tomlinson family i now how painfull is to lose a child. But i dont like whe someone has his heart full of evil and think that doing something like sues for money it goins to give you your baby back! I wish that someday we will know what really happend there and for the Tomlinson family i wish that they can heal and be happy again. I hope the best for Rosa's family too because they lost a child too!

1. Do anyone know why really the jury convicted Joshua?

Answer- It does not matter at this point why the jury convicted him. The jury heard the case and evidence and elected to convict him and give him life in prison. Regardless of what anyone thinks right now is beside the point.

2. Do anyone know how the press work in mind of everyone?

Answer --The power of the press, no one can say how the press worked in the minds of everyone and personally the only press I read pre-trial was Joshua Rosa himself saying they arrested the wrong person. So to claim the press influenced my opinion would be incorrect.

3. Do anyone how think Joshua is guilty knows him?
Answer -- Again, who knows? And better yet who cares? Does it matter if anyone knows him or not? He has people willing to help him out and he so far has refused to respond to people willing to help him.

I have posted time and time again I have really strong mixed feelings about this case and I find this case to be very intriguing for some reason.

There are several people in the same situation as I am. We don’t know him but would like to talk to him to find out if we can help.

4. Do Joshua was guilty beyond any reasonable doubt?
Answer --Again, you are wasting time that Joshua does not have. To argue if he was guilty beyond any reasonable doubt, the jury said he was guilty beyond any doubt. Sadly it does not matter what I think or what you think.

Again, what does matter is if Josh Rosa needs help, he needs to let people know so they can help him. Remaining silent right now is not a good thing. We don’t even know if Josh wants help at this time.

We don’t know if he has elected to accept responsibility for this crime and spend the rest of his life in prison or if he wants to appeal the case and just cannot afford to hire an attorney. We just don’t know what to do at this point.

Again, we want to help but cannot until we hear from Rosa himself.

He is out of time for appeals and some legal action, I just hope if he does need help its not too late to help him out.

5. Do the system really works?
Answer--Does the system really work? I have to say yes it does. The system has some problems but overall I think we have the best system. The system processes an ungodly number of people every single day.
People claim the system failed Josh, not really when you look at it. The system worked just fine. The system processed him and a jury of his peers elected to find him guilty based on the trial.

The biggest problem with the system is the defense attorneys and the games they play to make more money and waste more time of the courts and try to discredit the system and make people believe the system is so messed up any innocent man could be jailed for no reason.

The attorneys are supposed to be there to ensure the rights of the accused are not violated. However attorneys have turned court into games to prove guilty are actually innocent. Defense attorneys make me sick for the most part.
But at the same time, I would want the very best game player if I were ever to be arrested for anything.

And right now for Joshua, we need an awesome attorney to provide legal advice and give us direction in how to proceed.

I’m also comfortable enough to know our system will also correct the wrongs the system has made. If new evidence comes up in this case the system will handle that evidence just like they did with Josh. If someone confesses or is convicted of this murder, then the system will release Josh.

Thank you for not saying Josh is a nice guy. That defense alone has done nothing but waste more time than anything. He might be the nicest guy in the world, but obviously that made no difference at his trial.

We have people that want to find out if his is the nicest guy in the world and until he responds to someone trying to help, no one will ever know.

I agree with you. A lot of the evidence is circumstantial. To argue that point right now is doing nothing but wasting time that Josh does not have.

Regardless of what anyone thinks of this case, it does not matter now.

What matters, as I have posted before is that we can form a group to support Josh and get him the help he needs or wants.

I’m also very sorry to hear about your lose.

I also feel very bad for the Tomlinson family. I could never imagine losing a loved one in a situation like this. I could not even begin to understand how they feel and I as well hope they can learn to deal with his death and continue to live a happy life.

I as well feel bad for the Rosa family. I again could not imagine how they feel.

I posted before that 2 young people lost their life in this case.

Sadly there seems to be nothing happening to help Josh.

Nothing will change as long as people want to continue to argue about the case, evidence, forensics and the trial or jury.

Now is a time for us to pull together and actually try to help him if he even wants our help.

I want to thank you very much for your comments.

I would also like to ask that all other comments be send to www.joshrosa.blogspot.com

I have been trying to get a blog started just for Josh and the people that support him.

Thanks again for your comment. I hope to hear more from you.

I want to talk to some that actually knew Josh.

Do you have any pictures of Josh? If so can you please send me some?

I’m looking for pictures to use on his blog since all I have are court pictures.

And if you would ever like to talk, let me know. I will call you or you can call me.

Does anyone know if there is video of the Joshua Rosa murder trial anywhere?
