Javon Dawson death was ruled and justifiable by the State Attorney.

The Pinellas-Pasco State Attorneys Office has completed its investigation and ruled the death of Javon Dawson was justified. The report said St. Petersburg Police Officer Terrence Nemeth was justified in his use of deadly force.

According to the report, Officer Nemeth did observe Javon Dawson with the gun and seen the muzzle flashes as Dawson fired the gun and then observed him pointing the gun at the crowd.

Javon Dawson was told to drop the gun and as Officer Nemeth pursued Dawson, Officer Nemeth said Dawson looked over his shoulder and raised the gun behind him, pointing the barrel at me. Officer Nemeth then shot Javon Dawson twice.

The family and friends denied that Javon Dawson had a gun, however, according to the State Attorneys report, the lab analysis found Javon Dawson’s DNA on the gun and gunshot residue on Dawson’s pocket. The report also indicated that 3 bullets fired from the same weapon that night was recovered by police.

The state attorney says that evidence together with Nemeth's testimony makes it a justified shooting.




Now David Dawson wants to know why this was released one day prior to him asking Gov. C. Crist to pull Pinellas State Attorney Bernie McCabe off the case.
Now my question would be was Bernie McCabe aware that the Uhuru had directed David Dawson to make this request?

This investigation has been underway since June 8, 2008.
The Uhuru has interfered in the investigation of this case and for weeks in the paper after the shooting, not one single witness would make a statement because of the Uhuru.

The Uhuru tried to make the community scared of the police claiming they wrongfully killed a teen.

Now David Dawson thinks the report is bull. David Dawson said he was supposed to go to the governor tomorrow morning and all of the sudden they come out with the ruling. Now what’s up with that there man? Put two and two together.

The report also states Dawson associated with a gang known as the "Third Avenue Boyz" -- a claim that angers Dawson's father.

"What kind of gang? Ain't no, what's gang," David Dawson said. "Come on now man, that boy wasn't in no gang."

The Uhuru questioned why the state attorney didn't use a grand jury to make the ruling.

Bernie McCabe said in his report that there has been some conversation and speculation that the Pinellas County Grand Jury might be asked to conduct this investigation. After reviewing the testimony we have received, we have concluded that to do so would be contrary to our long established practice of seeking the Grand Jury’s assistance only in those instances where there is a factual dispute or conflict that impacts the legal conclusion. This investigation revealed no such dispute or conflict.

I wonder at what point and time the Uhuru and David Dawson will address the issues with Javon’s brother Keon. According to the report Keon lied under other and said there were no guns at the party, even though the neighbors called the police for shots fired and other witnesses in his own group testified that there were weapons there. The report went on to say that Keon gave conflicting information and was evasive and less than forth coming in this investigation.

Or is this what the Uhuru wanted to ensure there was conflict to help prove their case that the police were wrong?

This is truly a sad situation. The Dawson’s lost a family member. Now they want to place blame on the police and the State Attorneys Office.

When you put two and two together you get this

Javon Dawson had a gun and fired it + Javon was shot for failing to comply with police orders.



The Uhuru is something I know nothing about and must say I thank God I don’t.
It seems there plan was to come to town and create chaos and disorder and build a false sense of fear among the community to fear the police. It seems there plan has failed as far as the justice system is concerned, they may have instilled fear in some but overall the justice system has prevailed.

And now they are concerned why?
