Tea time or snort a line or two of cocaine
Jerome Klein, 50, was released from Broward County Jail after a judge ruled a Bolivian tea he drank was the reason he failed a drug test and violated the terms of the bond.
The tea is Mate de Coco. It is made from the coca plant which was reported that it just so happened that Klein had some just prior to a random drug test in April. He failed the test and was thrown back in jail.
In May, state prosecutors said Klein's urine contained too high a concentration of cocaine to be caused by drinking tea.
But Friday, Theodore Mastos, a former Miami-Dade County judge, convinced Circuit Judge John Murphy III that Klein was the unknowing victim of the herbal brew.
''His mom loaded the guy with the tea. It's full of cocaine,'' Mastos said. ``This was an aberration. He's not a junkie.''
Klein has no criminal history aside from the burglary allegations and has never been arrested on drug charges, records show.
A look at the results revealed Klein's urine contained 30 times more cocaine concentration than originally reported.
Klein had passed an April 4 blood test but fell ill about a week later. His mother gave him the tea to make him feel better, she said.
''I made the tea. It was my fault,'' Shulamit Klein said. ``I won't use the tea anymore.''
And yet we wonder what’s wrong with our criminal justice system.
Maybe the mom should be arrested for distribution of cocaine.
