Do you remember the post on Bobby Cutts?



Well if not, let me refresh your memory. Bobby Cutts Jr., was a police officer and he was sentenced to life in prison for killing his pregnant lover and the fetus.




Now the Defense is requesting a new trial because they claim the jury handed down contradictory verdicts.

Cutts filed the appeal on Friday. Cutts, 31, was convicted in February.
Cutts continued to work for the police department as thousands were out looking for Jessie Davis. Cutts denied knowing anything about her disappearance while everyone was out looking for her.

It was during this time that a friend of Cutts came into the picture and said he helped Cutts dispose of the body after he called her and asked for help.

Now the defense wants to claim the jury handed down contradictory verdicts in this case. This came from the fact that the jury found Cutts guilty of aggravated murder in the death of the fetus and a lesser charge for the death of Davis.

The filing argues that convicting Cutts of murder in Davis' death and aggravated murder in the fetus' death was inconsistent because both deaths were the result of the same act. Yet he still murdered two people.

The defense also claims the jury lost its way and created a manifest of miscarriage of justice and they think the conviction should be reversed and a new trial ordered.

Cutts' attorneys also argue that the judge presiding over the trial should have allowed jurors to consider an involuntary manslaughter conviction because no witnesses contradicted Cutts' claim that he did not purposely kill Davis. Cutts testified that he accidentally hit Davis in the throat with his elbow during an argument and that he dumped her body in a panic.

Among other issues, Cutts' attorneys also say the trial should have been held outside Stark County, where the crime was committed, because intense media coverage made it difficult to find an impartial jury.

Then the defense wants a change of venue. The defense claims in the appeal that members of the jury helped search for Davis’ body and seen the media reports about the death and the defense claims the jury was tainted and had already convicted Cutts before the trial started.

The State said they were not surprised that these issues came up in appeal, since most of them were also addressed during trial.

I hope that Bobby Cutts, Jr. gets a new trial.

This time, hopefully the prosecution will elect to seek the death penalty and he will be put to death for murdering his lover and un-born baby.
